Terms of service

Applicability

The terms of service are applicable for all services and products offered by the Happshot application or website unless stated otherwise.

Return policy

  1. It is not possible to make use of the right of withdrawal (herroepingsrecht) for our products. The content of the photo packs are made by the user and are therefore regarded as a personalised product.
  2. It is possible to get a new pack if the original was damaged on arrival, however, strict rules apply. The damage should clearly originate from either transport or a mistake on our part.
  3. The return policy will expire if it is clear that the product was damaged or used in a way that otherwise does not conform to checking the state of the product. This includes exposing the pack or it’s photos to conditions that are not suitable for photos, like water or too much sun.
  4. It is not possible to make use of this return policy if the images (not the material) are not to your liking. By making use of the app you accept the risk that photos can be vague or look bad otherwise. Colors may differ between expectations and the final result.
  5. If a customer is not satisfied with the conditions of a delivered photo pack according to section 2, please send an email to info@kaster.group with as many details as possible (preferably pictures of the damaged item).
  6. We are not responsible for photos you take using a broken phone camera. If any printed photos are of bad quality due to the condition of the camera, the return policy will not apply.

Data loss

  1. All gathered data stored in our database or used for our services conform to the GDPR. To read more about the privacy of your data, please read the privacy statement: https://kaster.group/privacy.html.
  2. We take data protection seriously and try our hardest to make sure your data is stored at multiple locations in a secure way. However you are in the end responsible for your data. We are not responsible for the loss of photos or other loss of data outside of our control.
  3. If you delete packs, we will not be able to retrieve those from our database, and therefore will not be able to print them or allow you to watch them in the application.

Fair use of photos

  1. You guarantee that all photos you take conform to the following rules:
    1. No nudity or otherwise erotic content
    2. No advertisements for illegal activities
    3. No advertisements for pornographic or erotic activities, like prostitution or escort services
    4. No violence
    5. No pictures that contain imagery of illegal activities
    6. No imagery inciting violent riots or terrorism.
    7. Does not contain imagery that otherwise does not conform to the law.
  2. You understand that failing to meet the requirements in section 1 can lead to being removed from the application, alongside the taken pictures. Any purchased packs will not be refunded.
  3. If you see photos taken by other users failing to meet the rules of section 1, you are urged to report it using the in app feature or contacting us using info@kaster.group so we can deal with it.
  4. You guarantee that the photos you take do not infringe the rights of any third parties. These rights include, but are not limited to copyrights and privacy rights.

Account

  1. You are responsible for your own account data. While we do provide a way to restore your password, in the end, you are responsible for your credentials. We are not responsible if you lose access to your account due to forgetting your credentials.
  2. We are not responsible for anything that happens if you share your account with others. Your account contains personal data so be careful sharing it with other people.
  3. We are allowed to remove your account at all times if you do not conform to the terms of service.

Prices

  1. Prices mentioned in the app or on the website include BTW and (if applicable) transport costs.
  2. Prices and offers are prone to change. KASTER Group cannot guarantee that prices mentioned in advertisements, on the website or in emails stay constant.
  3. You are responsible for making sure that discount codes are still valid. Carefully read the specifications of the code when receiving it.
  4. Some payment methods may add extra costs to the price mentioned on the app or website.

Complaints

  1. We take quality and customer support seriously and will try to adhere to these values at all times. If you however do have a complaint, please notify us as soon as possible so an agreement can be reached. Make your message to us as detailed as possible so that the best possible solution to the situation can be found.
  2. If you want to make use of the earlier mentioned return policy, or if you have an issue with anything regarding the application, products, or otherwise, contact us at info@kaster.group.

Availability of our services

  1. We are not responsible for any issues with services or products that are not caused by us. This includes any issues with postal companies, low quality photos or data loss.
  2. We are not responsible for any issues you have with your phone, like memory or performance loss, after installing this application.

User terms

  1. You guarantee that you will not try to hack the application, or insert any malware or viruses.
  2. You guarantee that you will not use the application for any harmful or illegal activities.
  3. If there is any suspicion of illegal, harmful or otherwise unwanted activities you will be removed from the application. Furthermore, authorities may be notified on these activities.
  4. You guarantee that you will not try to reverse engineer the application’s code, or try to copy (elements of) the application.
  5. You guarantee that the photos you take will not infringe any rights of third parties, including copyright and the right to privacy.
  6. You guarantee that you will not use the application for hateful speech, racism, or any discriminatory language.
